MOTION TO ACCEPT Grant Agreement between Broward County and the U.S. Environmental Protection Agency (“USEPA”) under the Clean Ports Program, Grant Award No. 03D31321, in the amount of up to $300,000 to fund 100% of the Port Everglades Air Emissions Study; to authorize the County Administrator to execute any amendments to the Grant Agreement, provided there is no increase in the County’s financial obligations and subject to review of all such documents for legal sufficiency by the Office of the County Attorney; and to authorize the County Administrator to take all administrative and budgetary actions related to the grant.

Why Action is Necessary
Section 20.31(b)(3) of the Broward County Administrative Code requires that the Board of County Commissioners (“Board”) approve all state and federal grant agreements. Florida Statutes Section 129.06(2)(d) requires a budget Resolution to recognize unanticipated grant revenue in the budget.
What Action Accomplishes
This grant will provide funding to perform an air emissions study to update the Port Everglades’ 2015 Baseline Air Emissions Inventory with new data/methodology and conduct a comparative analysis of changes in air emissions over time.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”
This grant will provide funding from the U.S. Environmental Protection Agency (“USEPA”) in an amount of up to $300,000 under the Clean Ports Program funded by the Inflation Reduction Act to update the Port Everglades’ 2015 Baseline Air Emissions Inventory with new data/methodology and to conduct a comparative analysis of changes in air emissions over time. The Baseline Air Emissions Inventory completed in 2015 was fully funded by the County, with the USEPA only providing technical assistance. The updated inventory will include both quantitative and qualitative data and prioritize planned air emission reduction strategies among identified sources and include community and port workforce stakeholder engagement as part of the process. The intent is to use the same methodology followed when the 2015 Baseline Air Emissions Inventory was completed to allow for a direct comparison.
The expected outcomes include increased understanding of current port air emissions and changes from 2015, identification of potential strategic long-term investments to further reduce emissions, increased stakeholder participation in port planning and decision making, and improved understanding of how workers’ roles may evolve. The intended beneficiaries include the Port, near-port communities, organizations interested in port emissions, and the public.
The Grant Agreement has been reviewed and approved as to form by the Office of the County Attorney and does not require execution by the County for acceptance.

Fiscal Impact/Cost Summary
The grant provides up to $300,000 for the Port Everglades Air Emissions Study and the EPA agrees that this is a 100% cost-share with no matching funds required from Broward County. The County will be responsible, however, for any costs exceeding the grant amount using funds already budgeted.
