Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.94.a, Board approval is required for amendments to contracts exceeding the award authority of the Director of Purchasing.
What Action Accomplishes
Allows the Consultant to continue providing construction-phase engineering services for numerous projects by extending the Agreement time for performance.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development established County Business Enterprise (CBE) participation goal for this Agreement of 30%. As of June 29, 2020, Hazen and Sawyer has been paid $14,646,863 with $3,797,247 paid to CBE firms, yielding a 25.9% CBE participation to date (Exhibit 1).
On February 11, 2014 (Item No. 15), the Board of County Commissioners approved the Agreement between Broward County and Hazen and Sawyer, P.C. for Consultant Engineering Services for the North Regional Wastewater Treatment Plant - Facility Improvements in Broward County, Florida, RLI No. R1007402R1 (Exhibit 2) for services associated with a range of engineering services for a total amount of $10,902,161 and time for performance of 1,825 consecutive calendar days.
On November 10, 2015 (Item No. 8), the Board of County Commissioners approved the First Amendment to Agreement RLI R1007402R1 (Exhibit 3) for services associated with a range of engineering services related to the North Regional Wastewater Treatment Plant for studies, planning, design, procurement, and engineering services during construction of numerous projects, increasing the total Agreement amount to $26,127,616 with a total time for performance of 2,375 consecutive calendar days.
The proposed Second Amendment to the Agreement (Exhibit 4) is a request for an increased time for performance of 1,000 days for a total time for performance of 3,375 consecutive calendar days.
The final negotiations for the Amendment was negotiated on May 22, 2020 and the Amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
