Summary Explanation/Background
The Urban Planning Division administers the assessment and collection of fees consistent with the Third Amendment to Interlocal Agreement ("TRILA") among the Broward County School Board ("School Board"), Broward County ("County"), and twenty-seven (27) municipalities. In compliance with the terms of the TRILA, the School Board selected Alfred Benesch & Company to prepare the Broward County Public Schools Student Generation Rates and School Generation Rates and School Impact Fees Study Update, Final Report, June 14, 2024 ("New Study").
On July 23, 2024, the School Board adopted Resolution No. 25-02, whereby the School Board (i) adopted the recommended Student Generation Rates (Hybrid Method) found in Table 1, on Page 9 of the New Study; and (ii) maintained the currently adopted impact fee as reflected in the New Study.
The proposed Ordinance (i) ratifies the existing impact fees and (ii) amends Section 5 182.9 of the Land Development Code to update the Student Generation Rates consistent with the New Study and Resolution adopted by the School Board. The proposed Ordinance streamlines the existing Student Impact Fee Schedule to reflect the ratified fee per unit.
On August 29, 2024, the Broward County Planning Council found the proposed Ordinance consistent with the Broward County Comprehensive Plan.
