Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This item accepts a Special Warranty Deed (“Deed”) conveying a 59-square-foot parcel of real property (“Parcel”) from MPLX Terminals, LLC (“Grantor”) to Broward County at no cost to the County. The Parcel is located along the west side of Eisenhower Blvd. between SE 20th Street and SE 18th Street south of the 17th Street entrance to Port Everglades (see Exhibit 2). The County requires the Parcel to facilitate the relocation of an existing Port Everglades variable messaging and wayfinding sign from the median of Eisenhower Blvd. to this parcel. Relocation of the sign is required for construction of the Port Everglades Bypass Road Project.
Broward County will accept the Parcel on an “as-is” basis, taking on all associated responsibility and liability. The Deed releases Grantor from any claims related to environmental contamination present on, under, or migrating from the Parcel (“Release”). This Release is specific to the Parcel and does not extend to the adjacent property that Grantor is retaining. The Release does not affect Broward County’s regulatory authority as a governmental entity. Additionally, the Deed allows Grantor to access the Parcel to conduct environmental investigations or remediation activities related to Grantor’s adjacent property. Should Grantor cause any damage to any improvements on the Parcel or County’s personal property, Grantor is responsible for either repairing the damage at its own expense or reimbursing the County for the repair costs.
County staff has reviewed available environmental reports in the vicinity of the Parcel, and there is a low likelihood of contamination. In the event contamination is encountered, it will be addressed during the relocation of the sign with minimal impact on the project. Accepting the Parcel aligns with the County's best interests.
The Resolution and Deed have been reviewed and approved as to form by the Office of the County Attorney.
