A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE TREE PRESERVATION TRUST FUND; AMENDING SECTIONS 27.186 AND 27.187 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE") PERTAINING TO DISBURSEMENTS FROM THE TREE PRESERVATION TRUST FUND; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

The proposed Resolution supports the Board's goals of: "[e]nsuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection;" "[e]nsuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity;" "[e]nsuring economic opportunities and a sustainable economy, with an emphasis on Broward's lower and middle class;" and "[c]ultivating community culture, arts, recreation and life long learning."
The proposed Resolution amends Section 27.186 of the Broward County Administrative Code to allow the Tree Preservation Trust Fund Committee ("Committee") to consider (i) tree planting project proposals supported by the Resilient Environment Department ("RED") that are located on private or public lands and that may include a sculptural or artistic element; and (ii) project proposals for maintenance expenses, including maintenance equipment and vehicles, used to encourage the growth of the tree canopy for existing trees located on sites operated by the Broward County Parks and Recreation Division and planted pursuant to a distribution made by the Tree Preservation Trust Fund.
The proposed Resolution also amends Section 27.187 of the Administrative Code to exempt developers of certain affordable housing projects from the requirement to make a written request for funding of mitigation expenses arising pursuant to Section 27-413(d)(3) of the Broward County Code of Ordinances ("Affordable Housing Tree Mitigation") and to provide for administrative processing of Affordable Housing Tree Mitigation that will, to the greatest extent practicable, be expedited by RED staff. The proposed Resolution further amends Section 27.187 of the Administrative Code to grant the Director of RED the authority to determine the appropriate method and timing of funding Office of Economic and Small Business Development Projects with Tree Preservation Trust Fund monies.
