MOTION TO AUTHORIZE Director of Purchasing to negotiate, approve, and execute an appropriate Participating Addendum between Broward County and Cheney Bros., Inc., dba Cheney Brothers, Inc., in substantially the same form attached as Exhibit 1, subject to review and approval for legal sufficiency of the Participating Addendum by the County Attorney’s Office.

Why Action is Necessary

For both Motions A and B, in accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Authorizes the Director of Purchasing to purchase on an as-needed basis from the open-end contract awarded to Cheney Bros., Inc., dba Cheney Brothers, Inc., under the competitively procured Martin County, Florida, Contract No. RFB2022-3382, for the purchase of food, food service supplies, and cleaning products for the Broward Addiction Recovery Division; and to negotiate, approve, and execute a Participating Addendum with Cheney Bros., Inc., dba Cheney Brothers, Inc.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE HUMAN SERVICES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Healthy Community Goal, “Delivering accessible human services that holistically address the whole person collaboratively and compassionately.”

 

The Office of Economic and Small Business Development did not reserve this project for Small Business Enterprises or assign County Business Enterprise participation goals based on the review of products and services requested.

 

Section 1-81.3(a) of the Code of Ordinances provides for the setting of a CBE goal of at least 25% unless the Board of County Commissioners or County Administrator (under limited circumstances) approves a different goal, or no goal based upon a written determination by the Director of the Office of Economic and Small Business Development (OESBD). The Board’s approval of this item will result in no CBE goal being set for the applicable agreement consistent with the written determination provided by the Director of OESBD (Exhibit 2).

 

On December 27, 2021, Martin County advertised a competitive Bid No. RFB2022-3382, and the bid closed on January 19, 2022, with four responses (Exhibit 3).

 

On February 22, 2022, Martin County Board of County Commissioners approved Item 22 0309 to award Contract No. RFB2022-3382 to Cheney Bros., Inc., dba Cheney Brothers, Inc. (Cheney Brothers), for an initial three-year term with the option to renew for two additional one-year terms, for a total potential five-year term agreement (Exhibit 4).

 

The Human Services Department requests approval to utilize the Martin County, Florida Contract No. RFB2022-3382 for Food, Food Service Supplies & Cleaning Products for Broward Addiction Recovery Division (BARD), (Exhibit 5).

 

If this item is approved, the Director of Purchasing will be authorized to purchase on an as-needed basis from the open-end contract awarded to Cheney Brothers, under the Martin County, Florida, Contract No. RFB2022-3382, for the purchase of food, food service supplies, and cleaning products for BARD; and to negotiate, approve, and execute a Participating Addendum with Cheney Brothers.

 

The Human Services Department and the Purchasing Division have reviewed the bid and awarded contract and have determined that utilizing the Martin County agreement will save the County time and money, and Cheney Brothers, can meet BARD’s requirements to provide food, food service supplies, and cleaning products.

 

The initial term of the open-end contract begins on the date the Participating Addendum is signed by all parties.
