A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, AUTHORIZING APPROPRIATION AND DISBURSEMENT OF RYAN WHITE PROGRAM FUNDS TO SPECIFIED SERVICE PROVIDERS IN THE ESTIMATED AGGREGATE AMOUNT OF $20,206,459 FOR RYAN WHITE FISCAL YEAR 2025-2026; AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE NEW AGREEMENTS WITH SPECIFIED SERVICE PROVIDERS AND TAKE ALL NECESSARY ADMINISTRATIVE AND BUDGETARY ACTIONS TO IMPLEMENT THE AGREEMENTS; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

B. MOTION TO APPROVE single source determination for the State of Florida Department of Health, Broward County Health Department to provide Public Health Surveillance, Disease Intervention Specialist services in Broward County from March 1, 2025, through February 28, 2026 in the amount of $312,000, with four one-year renewal periods, for a five-year potential amount of $1,560,000, to link and retain people with HIV/AIDS to core medical and support services that improve health outcomes and reduce the transmission of HIV/AIDS.

Why Action is Necessary
A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for agreements with external agencies.
B. Service provider agreements resulting from single source determinations must be approved by the Commission in accordance with Chapter 23, Broward County Administrative Code.
C. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.
What Action Accomplishes
Adoption of Motion A and approval of Motion B authorize the distribution of funds to provide needed health care and support services to Broward County residents living with HIV/AIDS.
Approval of Motion C waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission's value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” These actions will also ensure services are available to eligible Broward County residents living with HIV/AIDS.
Broward County has received federal funds from the U.S. Department of Health and Human Services, Health Resources and Services Administration (“HRSA”) since 1991. The Human Services Department (“HSD”) has historically received Notices of Award (“NoA”) from HRSA close to, or after, the commencement of the Ryan White (“RW”) federal fiscal year, which is March 1 to February 28.
On September 5, 2024, (Item No. 8), the Commission approved the HRSA RW Part A and Minority AIDS Initiative (“MAI”) grant application for the award period from March 1, 2025 through February 29, 2028. On January 21, 2025, Broward County received a partial NoA for Part A and MAI in the amount of $3,002,355 (Exhibit 2) and expects to be awarded the full grant.
On October 8, 2024, (Item No. 8), the Commission approved the HRSA RW Ending the HIV Epidemic in the U.S. (“EHE”) grant application for the award period from March 1, 2025, through February 28, 2030. On January 15, 2025, Broward County received a partial NoA for EHE in the amount of $1,341,097 (Exhibit 3) and expects to be awarded the full grant.
To avoid an interruption of needed health and support services funded by RW Programs, HSD is requesting Commission authorization for appropriation and disbursement of RW funds to specified RW Part A, MAI and EHE service providers commencing March 1, 2025 (Exhibit 1, Attachments A and B). Agreements with specified service providers identified with an “R” in the attachments will be renewed in accordance with the terms and conditions of the agreements. Agreements identified with an “N” in Exhibit 1, Attachments A and B are new agreements with specified service providers selected through open, competitive requests for proposals process. The Agreement identified with a “NSS” in Exhibit 1, Attachment B is pursuant to a new Single Source Request (Exhibit 4). Outcome Achievements for entities providing services during Ryan White Fiscal Year 2023-2024 (the last complete fiscal year) are reported on Exhibit 5, Attachments A and B. Agreements will be reviewed and approved by the Office of the County Attorney for legal sufficiency prior to execution by the County Administrator.
Approval is requested for the Florida Department of Health (“FDOH”) to be designated as a single source provider to rapidly identify the eligible population and provide intensive HIV/AIDS education and secondary prevention services, readiness for care counseling, active linkage, and re-engagement services for eligible Broward County residents living with HIV/AIDS who dropped out of care (Exhibit 4). The FDOH is the only public health authority designated to provide these services to this population.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee.” In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion C) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 6 and constitute full disclosure of any existing conflict.

Fiscal Impact/Cost Summary
Broward County’s RW and EHE Programs are 100% funded through federal dollars from HRSA. No Broward County funds are required. These programs would be discontinued if grant funding were no longer available.
