Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Parks and Recreation Division has miscellaneous construction projects scheduled at Deerfield Island Park that require an off-site staging area for transporting materials and equipment to and from the island by barge. Alsdorf Park, owned by the Florida Inland Navigation District but operated and maintained by the City of Pompano Beach (“City”), is regularly utilized by various governmental agencies as a staging area site for waterway transport of construction materials and equipment.
County has entered into similar license agreements with the City twice before, once in 2023 and once in 2024. The most recent license agreement expired on February 15, 2025.
This item seeks approval of a new license agreement (“Agreement”) between County and the City to allow County to continue using the staging area for ongoing construction. The Agreement will commence upon its execution and will remain in effect for one year or until project completion, whichever occurs first. The Agreement also includes a one-year renewal option upon written consent from both the City and County.
County will not be charged a fee to use the City’s property but may be financially responsible for repairing any damage caused by County’s use of the property to restore the property to its original condition. The Agreement is on the City’s form and does not include the County’s standard terms and conditions. Additionally, it includes an indemnification provision requiring the County to indemnify, defend, and hold harmless the City and the Florida Inland Navigation District from any claims arising from the County’s use of the staging area.
