AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO LICENSES, BUSINESS REGULATIONS, AND CONSUMER PROTECTION, INCLUDING TOWING AND IMMOBILIZATION SERVICES, AUTO TAG COURIER SERVICES, MOVERS, APPLIANCE REPAIR, AND MOTOR VEHICLE REPAIR SHOPS; AMENDING CHAPTERS 8½ AND 20 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Commission”) at its meeting of August 20, 2026.
What Action Accomplishes
Allows for the Commission’s consideration of the proposed Ordinance amending the Broward County Code of Ordinances (“Code”).

Summary Explanation/Background
This Ordinance would update the County’s Consumer Protection Code, with respect to towing and other matters.
On September 4, 2025, the Commission directed the County Attorney’s Office to draft an Ordinance amending various sections of Chapters 8½ and 20 of the Code relating to movers, towing and immobilization providers, motor vehicle repair shops, and motor vehicle body repair and painting shops.
Some of the changes pertaining to towing will align the Code with recent changes in Florida law. These include modified requirements that towing companies accept at least two forms of payment. Also, towing companies would be required to use tow lights and certain other safety equipment. The Ordinance would provide fines for violations of the new provisions. The Ordinance also would clarify that a towing license does not authorize licensees to drive the car being towed unless the owner consents.
Elsewhere in Chapter 20, the Ordinance would modify language pertaining to private couriers who obtain license plates and other tag/title documents for consumers through the Broward County Tax Collector (“Tax Collector”) or private tag agencies, to reflect that license plates are now a responsibility of the Tax Collector and not the County. The Ordinance also would add a fine for violation of an existing requirement that such couriers obtain bond in favor of the County.
The Ordinance also would modify the circumstances in which businesses licensed in certain fields would become ineligible for renewal due to previous violations of the same rule within a specified period.
Finally, the Ordinance includes numerous conforming, clarifying, and technical revisions, including updates for style and clarity, removal of superfluous and obsolete provisions, and to reflect the current names of County agencies.
