MOTION TO ADOPT Resolution, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, APPROVING AND AUTHORIZING BROWARD COUNTY TO LEASE CERTAIN REAL PROPERTY TO KAPPA FOUNDATION OF POMPANO BEACH INCORPORATED, A FLORIDA NOT FOR PROFIT CORPORATION, PURSUANT TO SECTION 125.38, FLORIDA STATUTES; DETERMINING THAT THE PROPERTY IS NOT NEEDED FOR COUNTY PURPOSES; DETERMINING THAT THE USE STATED HEREIN PROMOTES THE PUBLIC OR COMMUNITY INTEREST AND WELFARE; AUTHORIZING THE EXECUTION OF THE AGREEMENT OF LEASE; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

Summary Explanation/Background
Broward County is the owner of certain real property located at 3001 N.W. 8th Street, Pompano Beach, Florida 33069 (“Property”). The Resolution (attached as Exhibit 1) approves and authorizes Broward County to lease the Property to Kappa Foundation of Pompano Beach Incorporated, a Florida not for profit corporation (“Kappa Foundation of Pompano Beach”). Kappa Foundation of Pompano Beach is leasing the Property to provide foundation and other charitable and service organization services and support, fundraising and fundraising events, and meeting space and event space, as more particularly described in the proposed Agreement of Lease (“Lease”).
The rental payment for the Property will be Ten Dollars ($10.00) per year, for an initial term of ten (10) years. Kappa Foundation of Pompano Beach will have the option to renew the Lease for one (1) successive ten (10) year renewal term, in accordance with the terms and conditions set forth in the Lease.
The Lease may be terminated for convenience by the Board of County Commissioners with at least thirty (30) days’ advance written notice to Kappa Foundation of Pompano Beach.
