Why Action is Necessary

Section 125.01(2)(p), Florida Statutes, authorizes the Board to enter into agreements with other governmental agencies. Board action is required to approve and accept the Grant.

 

What Action Accomplishes

This action provides funding for air quality program support in Broward County and allows for appropriation of additional funding greater than approved via the budget authority of the Broward County Fiscal Year 2026 Adopted Budget.

Previous Action Taken

The original Grant award and Assistance Amendment 1, respectively A-00402625-0 and A-0040202625-1, in the total amount of $289,021, were approved by the County Administrator as a Summer Recess Agenda Item on August 21, 2025 (Item No.11).  Amendment 2, A-00402625-2, in the amount of $259,612, was approved by the Board on April 14, 2026 (Item No. 30).

 

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE NATURAL RESOURCES DIVISION (“NRD”) RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the County’s value of “Collaborates: Building partnerships and working collaboratively with others to meet shared objectives” and goal of “Resilient Community: Ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

The NRD’s Air Quality Program is a federally and state-approved local air quality program that protects and improves air quality in Broward County in accordance with state and federal regulations. For more than 30 years, EPA Section 105 grants have funded a significant portion of the program. The Air Quality Program implements the 1990 Clean Air Act Amendments and conducts ambient air monitoring, permitting and compliance verification, asbestos inspections, air quality analysis and planning, and public outreach.

 

Motion A formally accepts Assistance Amendment 3 to the U.S. EPA 105 A-00402625 grant in the amount of $548,633 for the budget period of October 1, 2024, through September 30, 2026, bringing the total amount awarded under this grant to $1,829,132, of which the County in-kind match is $731,866 ($365,933 annually approved in the Fiscal Year 2025 and Fiscal Year 2026 budget process), resulting in the EPA funding to date of $1,097,266 towards a total of $1,829,132. Assistance Amendment 3 was received from the U.S. EPA on May 8, 2026 (Exhibit 1).

 

Motion B adopts a budget Resolution for the award under this agreement in the amount of $458,245 (Exhibit 2).

 

Because the County is receiving funds from a federal agency under this Grant, the County’s standard terms are not included. The Grant also requires the County to submit an annual Federal Financial Report and an annual Performance Report to the EPA. The County Attorney’s Office reviewed and approved this amendment as to form.

Fiscal Impact/Cost Summary

This item allocates an additional $548,633 for a total grant award of $1,829,132 for activities associated with the U.S. EPA Section 105 Grant from October 1, 2024, to September 30, 2026.  Funding will be provided in part by the U.S. EPA in the amount of $1,097,266 and $731,866 ($365,933 annually) by the County for in-kind match. The match was approved in the Fiscal Year 2025 and Fiscal Year 2026 budget process. This amendment is utilizing the budget authority of the Broward County Fiscal Year 2026 Adopted Budget in the amount of $90,388.  The attached budget Resolution allocates the remaining $458,245.
