Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT, THE PARKS AND RECREATION DIVISION, AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The School Board of Broward County, Florida (School Board) is renewing its surface Water Use Permit from the South Florida Management District (SFWMD), for its irrigation system at Flanagan High School which is adjacent to CB Smith Park. The School Board utilizes the water from the CB Smith Park canal adjacent to Flanagan High School’s water pump system solely for irrigation purposes. The SFWMD is requiring proof that Broward County has authorized the use of the licensed area, which includes the use of the surface water and the infrastructure piping underground leading to Flanagan High School. This Revocable License Agreement (RLA) grants access to and withdrawal of surface water from the licensed area solely for irrigation purposes in perpetuity unless terminated by either Party.
It should be noted that this Revocable License Agreement is the finalized version that will be approved by the School Board of Broward County at its January 21, 2026 meeting.
