MOTION TO APPROVE U.S. Environmental Protection Agency (EPA) Cooperative Agreement PM-01D04920-5 (grant), in the amount of $94,579, to provide funding for the County’s Particulate Matter Monitoring Program from April 1, 2024 to March 31, 2025, and authorize the County Administrator to execute administrative and budgetary actions to implement the grant and allocate and implement subsequent partial awards not to exceed $25,022 under Agreement PM-01D04920-5, subject to review and approval by the Office of the County Attorney.

B. MOTION TO ADOPT budget Resolution within the Ambient Air Monitoring Fund for the Natural Resources Division in the amount of $94,579 for the purpose of protecting and improving air quality in Broward County.

Why Action is Necessary
Section 125.01(2)(p), Florida Statutes authorizes the Board to enter into agreements with other governmental agencies. Board action is required for Agreement approval to accept the grant award, and to recognize the award within the Resilient Environment Department’s portion of the County budget.
What Action Accomplishes
This action provides funding for air quality program support in Broward County and allows for the appropriation of this funding.

Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND NATURAL RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the County’s value of “Collaborates: Building partnerships and working collaboratively with others to meet shared objectives” and goal of “Resilient Community: Ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”
The Air Quality Program is a federal and state approved local air quality program responsible for protecting and improving air quality in Broward County, in accordance with state and federal regulations. The Natural Resources Division implements a federal and state approved local air pollution control program responsible for protecting and improving air quality in Broward County. The Air Program’s PM2.5 program is funded by the U.S. EPA Section 103 grant (Exhibit 1).
Motion A. retroactively accepts the U.S. EPA 103 PM-01D04920-5 grant over the budget period of April 1, 2024, through March 31, 2025. The grant was received from the U.S. EPA on December 9, 2024 (Exhibit 1).
Motion B. adopts a budget Resolution for the award under this agreement in the amount of $94,579 (Exhibit 2).
The County Air Program has been supported by the U.S. EPA Section grants for over thirty years. The program includes implementation of the 1990 Clean Air Act Amendments, as they relate to particulate matter pollution.
Because the County is a recipient of funds from a federal agency under this agreement, the County’s standard terms are not included. Moreover, the agreement imposes an annual Federal Financial Report and an annual Performance Report requirement on the County. However, this Agreement has been provided legal review and has been approved as to form by the Office of the County Attorney.
This Grant Agreement was approved as to form by the Office of Management and Budget Grant Section.
