MOTION TO AWARD open-end contract to low, responsive, responsible non-County Business Enterprise bidder, Condo Electric Motor Repair Corp.; for Gearbox, Pumps & Motors Repairs, Fabrication and Rehabilitation Services; Bid No. OPN2126696B1, for Water and Wastewater Services, in the annual estimated amount of $228,705, which includes annual allowances of $49,800; and authorize the Director of Purchasing to renew the contract for four one-year periods, for a five-year potential estimated amount of $1,143,525.

Why Action is Necessary
MOTION A: In accordance with the Broward County Business Opportunity Act, Broward County Ordinance Section 1-81.3(c), Board approval is required to waive County Business Enterprise goal requirements.
MOTION B: In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of associated contracts, with a value of more than 500,000, inclusive of the value of any renewals or extensions provided in the contract.

Motion B: Provides an open-end contract for the supply, fabrication and rehabilitation of gearbox, pumps, and motors for Water and Wastewater Services.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT / WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 8%. No CBE vendors responded to the solicitation. OESBD reviewed the vendors and determined that none of the firms are compliant with the CBE requirements in the solicitation (Exhibit 2). Motion A requests Board approval for the waiver of a CBE participation goal.
The purpose of this contract is to provide fabrication and rehabilitation services for the gearboxes at Water and Wastewater Services.
All prices, terms and conditions will remain fixed for the initial one-year contract period. Upon completion of the initial one-year contract period, the contractor may make a timely request for a price adjustment to the contract for each year thereafter prior to its anniversary date in accordance with the price escalation clause of the contract. The allowance items in this contract, in the total annual estimated amount of $49,800, includes $30,000 for parts and materials; $17,000 for specialty subcontracting services; and $2,800 for permit, licensing, and fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor’s actual incurred cost, without mark-up.
The apparent low bidder, DoneRite Pumps Inc, did not demonstrate that they have the capacity and experience to perform the requirements of the bid specifications. Water and Wastewater Services submitted a non-concurrence of award for DoneRite Pumps Inc (Exhibit 5), and the Director of Purchasing determined that DoneRite Pumps Inc, is non-responsible to the solicitation requirements.
Water and Wastewater Services reviewed the bid submitted by Condo Electric Motor Repair Corp. and concurs with the recommendation for award (Exhibit 3). Three vendor performance evaluations were completed for Condo Electric Motor Repair Corp. over the past five years. Condo Electric Motor Repair Corp. has a rating of 3.99 out of 5.0.
The Purchasing Agent researched the prices submitted by the apparent low bidder, Condo Electric Motor Repair Corp., and determined that prices submitted are fair and reasonable in comparison to a current Broward County contract for these same services (Exhibit 4).
Incumbent: Condo Electric Motor Repair Corp., Contract No.: OPN2120216B1, Contract Title: Gearbox Fabrication and Rehabilitation Services. Contract Term: September 22, 2020 to December 20, 2023. Expenditures to date: $299,974.76.
The Recommendation for Award was posted on the Purchasing Division website from November 15 - 22, 2023. There was no protest or appeal filed against this procurement.
The bid posted on August 11, 2023, and opened on August 25, 2023; two bids were received with no declination (Exhibit 1).
The initial contract period shall begin on date of award or the expiration date of the current contract, whichever is later, and will terminate one year from that date. The contract consists of the solicitation and the vendors’ response thereto.
