Why Action is Necessary

Approval by the Broward County Board of County Commissioners (“Board”) is required for the execution of Supplemental Agreement No. 2.

Approves Supplemental Agreement No. 2, allowing the Federal Aviation Administration (“FAA”) to continue to construct, operate, and maintain navigation, communication, and weather aid facilities at Fort Lauderdale-Hollywood International Airport.

Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

On November 14, 2006 (Item No. 5), the Board approved a Memorandum of Agreement (“MOA”) between the County and the FAA covering all current and active navigation aid equipment at Fort Lauderdale-Hollywood International Airport (“FLL”).

 

On February 12, 2008 (Item No. 2), the Board approved Supplemental Agreement No. 1 to the MOA, which amended the MOA to include language allowing for backup generators and power supply for all Automated Surface Observing System (“ASOS”) facilities located at FLL.

 

The MOA expires on September 30, 2026, and the FAA has a continuing need to occupy the premises and operate the ASOS facilities. The proposed Supplemental Agreement No. 2 extends the term of the MOA for an additional twenty-year period, from October 1, 2026, through September 30, 2046, revises the list of facilities covered by the MOA at FLL, and updates certain terms and conditions.

 

There is no cost associated with Supplemental Agreement No. 2. The rights extended to the FAA are in consideration of the FAA's obligations to operate and maintain the navigation aid facilities.

 

The proposed Supplemental Agreement No. 2 has been reviewed and approved as to form by the Office of the County Attorney.
