Why Action is Necessary
In accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions: and Section 21.53, a County contract shall not exceed five years in duration without the express approval of the Board.
Pursuant to Section 332.0075(3)(b)1.c., Florida Statutes, a governing body must approve, award, or ratify any contracts for commodities or contractual services executed by or on behalf of a commercial service airport as a separate line item on the agenda and must provide a reasonable opportunity for public comment if such contract is executed by or behalf of a commercial service airport that is classified by the Federal Aviation Administration as a large hub airport and the contract amount exceeds $1.5 million.

Provides Microsoft license management in an efficient, enterprise-wide approach, by consolidating Broward County Aviation Department’s (BCAD) licenses with the existing Enterprise Technology Services (ETS) contract.

Summary Explanation/Background
THE PURCHASING DIVISION, THE AVIATION DEPARTMENT, AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Microsoft was standardized by the Board on July 9, 2002 (Item No. 15). The first reaffirmation was on September 27, 2011 (Item No. 40). The second reaffirmation was on September 23, 2014 (Item No. 28). The third reaffirmation was on October 6, 2020 (Item No. 33) for all Broward County agencies and offices to purchase through Microsoft current authorized reseller at the time of purchase.
On May 24, 2022 (Item No. 44), the Board approved Contract No. TEC2124576G1, Technology Catalog Solutions Agreement between the County and SHI International Corp (SHI). The contract utilized the Sourcewell competitively solicited open-end contract with SHI. Pursuant to the Agreement, SHI provides Microsoft software licenses and related items for BCAD, ETS, and other Broward County agencies. Microsoft does not sell licenses directly to customers; as such the County has entered into an enterprise agreement (EA) with Microsoft to acquire these licenses through the authorized reseller: SHI.
This amendment to the EA incorporates BCAD as an additional entity to the ETS EA (Contract No. TEC2124576G2). This amendment increases the contract by $863,385, for a new total not-to-exceed amount of $15,863,385. The Microsoft EA for BCAD expires on June 30, 2025. Pursuant to this amendment, BCAD will be coterminous with ETS through October 31, 2026.
Exhibit 1: Microsoft Amendment M71 (Program Signature Form, AMD000446446) facilitates the transfer of BCAD on-premises software licenses to the Server Cloud Enrollment (SCE) Agreement No. 48736328. This amendment ensures that the licenses currently held on-premises are officially moved under the terms of the specified SCE agreement.
Exhibit 2: Microsoft Amendment M130 and M97 (Program Signature Form, FY25-lbekdash-S-027) authorizes the transfer of our cloud-based licenses for BCAD to the ETS Enterprise Agreement No. 61530562. This amendment formalizes the migration of those cloud licenses under the designated ETS agreement.
Exhibit 3: Zero True Up EA No. 58469772 (Enterprise Update Statement) confirms that there are no additional license usage fees or adjustments required under the current Enterprise Agreement, effectively certifying that the license counts, and usage are accurate and settled.
Vendor signature pages are being processed; the agency will notify the Board if signature pages are not received prior to the June 10th Board meeting.
SHI has received vendor performance ratings (4.82/5.0). Copies of the vendor performance evaluations are available upon request.
