Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE BUILDING CODE DIVISION (BCD) RECOMMEND APPROVAL OF THE ABOVE MOTION.

Various provisions of the Administrative Code related to the Building Code Division ("Division") reference and implement requirements from the Florida Statutes, the Broward County Building Safety Inspection Program contained in Chapter 1 of the Florida Building Code, the Broward County Charter, and other provisions of the Administrative Code. The proposed Resolution amends Chapters 8, 38, 40, and 43 of the Administrative Code to update its provisions consistent with changes in the Florida Statutes, Building Safety Inspection Program, Broward County Charter, and other portions of the Administrative Code as follows:

•                     Amends Section 8.15, recognizing amendments to the Broward County Charter eliminating the Central Examining Board of Liquefied Petroleum Trades and consolidating the remaining five Boards into one Central Examining Board with two Divisions.

•                     Amends various provisions of Chapters 38 and 40 and Section 43.55 to update reference to fee waiver provisions for affordable housing.

•                     Amends Section 40.28 to update percentage of permit fees to be collected for the State Department of Commerce pursuant to Section 553.721, Florida Statutes, and update the name of the Building Safety Inspection Program consistent with Chapter 1 of the Florida Building Code.

Fiscal Impact

Fiscal Impact/Cost Summary

The proposed changes to the Administrative Code do not result in a fiscal impact to the County given that permit fees to be collected for the State Department of Commerce pursuant to Section 553.721 is a pass-through revenue, meaning this money is simply collected on behalf of another agency and paid to them.
