Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/ REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION / RESILIENT ENVIRONMENT DEPARTMENT AND HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of “ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity.”

 

Broward County (“County”) is the owner of a vacant lot within the Central County Community neighborhood of the Broward Municipal Services District (BMSD), folio number 504205131670 (“Property”). United Way of Broward County, Inc., a Florida not for profit corporation (“United Way”), has requested that the County convey the Property to United Way, for the purpose of including the Property as part of a project (“Project”) to construct not less than 83 affordable multifamily rental housing units, of which 90% of the units will be rented to individuals earning up to 60% of the area median income, 10% of the Units will be rented to individuals earning up to 33% of the area median income, and at least 80% of the units will be rented by one or more natural persons who qualify as older persons pursuant to the Federal Fair Housing Act of 1968.

 

The Project shall be subject to a 99-year affordability restriction, and the deed conveying the Property to United Way contains certain deed restrictions, including a reverter clause allowing for the Property to be reverted to the County if the Project is not completed pursuant to the terms of the deed and the declaration of covenants and restrictions.

 

The proposed Resolution authorizes the County Administrator to execute the Quitclaim Deed and authorizes the Broward County Real Property and Real Estate Development Director to execute and process normal and customary closing documents needed to convey the Property to United Way. Pursuant to Florida Statutes Section 125.38, the Board may convey County-owned property to a nonprofit entity organized for the purposes of promoting community interest in such property if not needed for County purposes.

 

All documents have been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
