Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for agreements with external agencies and to authorize the County Administrator to execute new agreements.

 

B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

 

What Action Accomplishes

Approval of Motion A provides continued funding for supportive services, housing, and rent assistance for individuals and families in Broward County who are experiencing homelessness, in addition to operational and administrative expenses.

 

Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” This funding supports continued access to supportive services, housing, and rent assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.

 

Commission approval is requested for the appropriation and disbursement of U.S. Department of Housing and Urban Development (“HUD”) grant funds to specified providers (Exhibit 1, Attachment A). Broward County is responsible for providing a HUD-required match for all projects listed on Exhibit 1, Attachments A and B.

 

Upon receipt of the grant award from HUD, existing agreements with the service providers identified with an “R” in Exhibit 1, Attachment A, will be renewed in accordance with the terms and conditions of the agreements. New agreements with the service providers identified with an “N” in Exhibit 1, Attachment A, will be in substantially the same form as the applicable standard form agreement approved by the Commission on September 5, 2024 (Item No. 7), and will be reviewed and approved as to form by the County Attorney’s Office prior to execution by the County Administrator.

 

On April 22, 2026, the Homeless Continuum of Care Board (“HCoC”) recommended renewal of the funding and approval of new agreements for the HUD grant funds (Exhibit 1, Attachments A and B). The HCoC letter of recommendation is included with this item as Exhibit 2.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires a two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached as Exhibit 3 and constitutes full disclosure of any existing conflicts.

Fiscal Impact/Cost Summary

The total HUD appropriation is an estimated $17,835,348, which includes an estimated $14,653,129 in HUD funding and an estimated $3,182,219 cash match from Broward County. Employee salaries currently included in the Human Services Department budget are used to meet the match requirement.
