A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, APPROVING AND ADOPTING THE BROWARD COUNTY 2026-2029 TITLE VI PROGRAM UPDATE; AUTHORIZING THE COUNTY ADMINISTRATOR TO SUBMIT DOCUMENTS REQUIRED BY THE FEDERAL TRANSIT ADMINISTRATION; AND PROVIDING FOR AN EFFECTIVE DATE.

TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the Board's Connected Community Goal of " Cooperatively Delivering an Efficient and Accessible Regional Intermodal Transportation Network" and its Accountable Government Goal of “Consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work and visit.”
A public hearing will allow public comments on the Broward County 2026-2029 Title VI Program Plan.
Pursuant to Federal Transit Administration (FTA) Circular 4702.1B, Chapter III, General Requirements and Guidelines, Section 8, any changes to the Title VI Program must comply with the public participation requirements in (FTA) Circular 4703.1, “Environmental Justice Policy Guidelines for Federal Transit Administration Recipients,” and 49 U.S.C. Sections 5307(b) and (c)(1), which require public participation and a locally developed process to consider public comment. Public participation must include outreach, opportunity for public comment, a public hearing, and a method to engage minority, limited English proficient, and low-income populations.
In accordance with Title VI of the Civil Rights Act of 1964, FTA Circular 4702.1B, “Title VI and Title VI-Dependent Guidelines for Federal Transit Administration Recipients,” dated October 1, 2012, transit providers are required to submit Title VI program updates on a triennial basis to the FTA. The Broward County 2026-2029 Title VI Program Plan document is posted on BCT’s website at <https://www.broward.org/BCT/Pages/TitleVI.aspx>. This plan has been updated with recent census data.
The primary objectives of the FTA’s Title VI Program are to ensure, without regard to race, color, or national origin, that recipients of federal financial assistance provide services for all persons that meet the following requirements: 1) plan for and operate transit services so that transit benefits and related services are made available and distributed equitably; 2) transit services are sufficient to provide equal access and mobility; 3) opportunities to participate in transit planning and decision-making process; 4) decisions on the locations of transit facilities and services are carried out equitably; and 5) that remedial and corrective actions are undertaken to prevent discriminatory treatment of any beneficiary.
No fiscal impact will occur resulting from this action. However, if Broward County does not comply with mandated requirements, it may be deemed deficient, and any pending federal grants cannot be approved by the FTA until the deficiency is corrected.
