Why Action is Necessary
Section 2-40(a) of the Broward County Code of Ordinances requires that the Broward County Board of County Commissioners (“Board”) authorize any commercial activities or occupation of any portion of Broward County’s Fort Lauderdale-Hollywood International Airport (“FLL”).

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APROVAL OF THE ABOVE MOTION.
This action provides for the approval of a License Agreement between Broward County and T-Mobile South, LLC (“T-Mobile”) to permit the use of a portion of the airport for the installation, operation, and maintenance of equipment for cellular personal communication service.
T-Mobile has installed equipment throughout FLL to provide for better cellular signal, capacity, and speed for the subscribers on their network. The enhanced cellular capabilities benefit the passengers, tenants, and employees at FLL.
The proposed License Agreement will be for a five-year term from the effective date, which is the date when the License Agreement is fully executed by both parties. The License Fee in the proposed License Agreement paid to FLL over the term of the agreement is estimated in the amount of $1,061,826.
The proposed License Agreement has been reviewed as to form by the Office of the County Attorney.

For use of the Airport facilities T-Mobile will pay the County a License Fee of $200,000 for the first year and increasing by 3% for each contract year. The estimated total value of the License Agreement is $1,061,826.
