Why Action is Necessary

Board of County Commissioners' approval is required pursuant to Broward County Administrative Code Section 20.31.b.3.

 

What Action Accomplishes

Extends the Agreement for 12 months to establish a new end date of June 6, 2027 and revises the project description and deliverables to reflect the construction and installation of a single 24-inch pipeline with 30-inch or 36-inch steel casing and updates reference to the Florida Department of Economic Opportunity (DEO) to reflect the renamed Florida Department of Commerce (DOC). This action also authorizes the County Administrator to execute future time extension Amendments.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE WATER AND WASTEWATER SERVICES ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board of County Commissioners' Value of "Encouraging investments in renewable energy, sustainable practices and environmental protection" with the goal to "increase water quality protection efforts and lead creative approaches to water storage and aquifer recharge, as well as diversification of water supplies, regionally.”

 

The project is to construct a 24-inch ductile iron secondary effluent water transmission main between the County’s North Regional Wastewater Treatment Plant (NRWWTP) and the City of Pompano Beach’s OASIS Reuse Facility (City). This City and County partnership will provide a solution to regional wastewater management and water reuse production challenges as well as mitigate risks associated with natural disasters such as hurricane events, droughts, and saltwater intrusion. It will also benefit the 11 large users who utilize the County’s NRWWTP for effluent management.

 

On June 7, 2022, the State of Florida, DOC, formerly known as the Florida DEO, and the Broward County Board of County Commissioners entered into agreement MT042 (Agreement) (Exhibit 1), with an end date of June 6, 2026. Construction is anticipated to be completed in June 2027. Therefore, a one-year extension was requested and granted by DOC, requiring an amendment to the agreement.

 

If approved, this First Amendment (Exhibit 2) is effective as of the date DOC executes and will extend through June 6, 2027, unless otherwise terminated as set forth in Agreement.

 

County staff will advise the Board if a signatured page from the grantor is not received prior to June 9, 2026.
