Summary Explanation/Background
PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Parks and Recreation Division requests that the Board approve a new standard form agreement for use with the County’s SWIM Central Program ("Program"). The new form clarifies the Program's practices and procedures and reflects incorporates the County’s current standard form agreement provisions.
The Children’s Services Council of Broward County ("CSCBC") has provided matching grant funds since 2002 to the Program, on a reimbursement basis with contracting agencies. In Fiscal Year 2025, CSCBC will increase reimbursement rates and funding for water-safety education for the group identified as most at-risk for drowning: children under the age of five years old. The additional funding directs resources for instruction of these young children and their parents outside of the normal school day. Administration of this new segment of the Program is clarified in the new standard form agreement.
Use of the standard form agreement will be in accordance with the authority provided in the Broward County Administrative Code, Section 13.91(h). Pursuant to that section, the Director of the Parks and Recreation Division may contract, either competitively or noncompetitively, outside the Broward County Procurement Code, on behalf of the County, for water safety instruction-education services utilizing standard form agreements approved periodically by the Board, subject to review for legal sufficiency by the County Attorney's Office, provided that for each contract the total payment of funds shall not exceed $100,000 annually and the total contract duration shall not exceed five years. This item also designates authority to the County Administrator to approve changes to the form agreement that do not increase the cost to County.
