Why Action is Necessary
Approval from the Broward County Board of County Commissioners is required for all contracts for supplies or services of more than five years. With the additional extension term provided in the proposed amendment, the term of the Agreement would be five years and six months.

Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
Broward County, through its Purchasing Director, entered into an agreement with Brandano Displays, Inc. (“Brandano”), for the operation of the Holiday Fantasy of Lights event in Tradewinds Park (the “Park), on November 6, 2019. The initial term of the agreement was two years. The agreement was subsequently amended by a First Amendment, dated October 21, 2022, and a Second Amendment, dated June 27, 2023, which each added an additional one-year extension term (all amendments, together with the original agreement, the “Agreement’). The Agreement currently has an expiration date of November 4, 2024. The proposed Third Amendment extends the term of the Agreement for an additional six months, through May 4, 2025. The additional extension term will extend the Agreement’s total term beyond five years.
Brandano pays County an annual guaranteed sum of $58,200 for each annual event. This annual guaranteed amount, along with all other terms and conditions in the Agreement, will remain the same for the new extension term despite the shorter duration. The additional extension term will allow the Parks and Recreation Division time to work with the Purchasing Division to finalize a new solicitation for the future operation of the Park’s Holiday Fantasy of Lights event.
