Why Action is Necessary
In accordance with Broward County Procurement Code Section 21.53(a), Duration of Contracts, unless otherwise provided by law or excepted herein, a County contract shall not exceed five years in duration, inclusive of any renewals or extensions provided for in the contract, without the express approval of the Board.

Provides for a revenue-generating Agreement for services by an operator for food and beverage at the Hollywood North Beach Park snack bar for the Parks and Recreation Division.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) did not assign County Business Enterprise (CBE) goals for this project (Exhibit 2). This is a revenue generating project that is not County funded.
Section 1-81.3(a) of the Code of Ordinances provides for the setting of a CBE goal of at least 25% unless the Board of County Commissioners or County Administrator (under limited circumstances) approves a different goal, or no goal based upon a written determination by the Director of the Office of Economic and Small Business Development (OESBD). The Board’s approval of this item will result in no CBE goal being set for the applicable agreement consistent with the written determination provided by the Director of OESBD (Exhibit 2).
The purpose of this contract is to award a concessionaire to provide food and beverage services for the snack bar at the Hollywood North Beach Park. Work performed on this contract consists of, but is not limited to, finance, design, construction, operation, maintenance, and management of the Concession Services of the Hollywood North Beach Park Snack Bar.
The initial term of the agreement is for five years. After the initial term of the agreement, the agreement may be extended for up to five one-year terms by the Director of Purchasing.
Total anticipated revenue to the County during the five-year initial term of this agreement is $134,000. This amount is based on an adjusted tiered minimum annual guarantee. This amount will be adjusted based on the actual sales, with the concessionaire paying 10% revenue for food sales and 25% of alcohol revenue in excess of the minimum annual guarantee.
The RFP was advertised on February 9, 2024, and, at the time of the submittal deadline on March 15, 2024, five firms submitted proposals.
On June 28, 2024, an Initial Evaluation Committee (EC) meeting was held. The EC determined that three out of the five firms were both responsive and responsible to the RFP requirements and would proceed to the Final Evaluation to be numerically scored and ranked by the EC.
On July 11, 2024, a Final EC meeting was held. After presentations, evaluation, scoring and ranking, the EC named HZIP LLC as the first-ranked firm.
The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from July 17 - 19, 2024, which provided an opportunity for any aggrieved proposer to file an objection. No objection was received.
The EC’s final recommendation of ranking was posted on the Purchasing Division website from July 22 - 26, 2024, which provided an opportunity for any aggrieved proposer to file a protest. No protest was received.
On July 26, 2024, in accordance with Procurement Code Section 21.42(k), Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.
Two negotiation meetings were held to negotiate the Agreement with HZIP LLC: August 14 and August 21, 2024. These meetings were attended by representatives from HZIP LLC and staff from the Parks and Recreation Division, the County Attorney’s Office, and the Purchasing Division.
