MOTION TO APPROVE Subordination Agreement related to a single-family purchase assistance HOME mortgage (“Agreement”) in substantially the form of Exhibit 1; authorize the County Administrator to approve and execute the Agreement and make any required modifications to the Agreement, provided such modifications do not impose any additional material financial risk on the County, and are subject to review and approval as to the legal sufficiency by the Office of the County Attorney; and to authorize the County Administrator or such other person designated by the County Administrator in writing, to execute customary required documents for such subordination, and take the necessary administrative and budgetary actions. Why Action is Necessary
Board action is required to approve subordination agreements in scenarios not expressly contemplated under Section 27.209 of the Broward County Administrative Code.
What Action Accomplishes
Provides Broward County (“County”) consent to a subordination agreement that will confirm that the first mortgage lender’s corrective re-recorded first mortgage, to add an additional borrower, does not alter the priority of the first mortgage loan or the subordinate status of the County’s HOME mortgage.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board’s value of “Customer Focus” by “delivering customer-centric solutions” and the Board’s goal of “Accountable Government: consistently delivering responsive, efficient, inclusive and equitable quality services.”
The County provided Susan G. McIntosh (“Borrower 1”) and Michael Ross (“Borrower 2”) with HOME Investment Partnerships gap funding to assist with the purchase of a single-family residential property (“Property”). This assistance is secured by a HOME Mortgage to Secure Loan recorded on July 14, 2025, as Instrument No. 120322665 in the Official Records of Broward County, Florida, securing a principal amount of $40,000 (“HOME Mortgage”).
The Property was also financed with a first mortgage loan provided by Housing Partnership, Inc., DBA Community Partners of South Florida (“Housing Partnership”). The first mortgage loan is secured by a mortgage recorded on July 14, 2025, as Instrument No. 120322664 in the Official Records of Broward County, Florida, securing a principal amount of $78,300 (“First Mortgage”). The County’s HOME Mortgage is subordinate to the First Mortgage.
Following the recording of the County’s HOME Mortgage and the First Mortgage, Housing Partnership determined that Borrower 2 was incorrectly omitted from the originally recorded First Mortgage. To correct this omission, the First Mortgage was re-recorded on December 15, 2025, as Instrument No. 120597158 in the Official Records of Broward County, Florida.
Broward County consent to the Agreement confirms that the re-recorded First Mortgage retains its senior lien priority and that the County’s HOME Mortgage remains in a junior position to the First Mortgage.
The Office of the County Attorney has approved the Agreement as to form.
