A. Why Action is Necessary
Motion A. Pursuant to Section 163.01, Florida Statutes, Commission approval is required for interlocal agreements between Broward County and other governmental entities. Commission action is required to approve the Interlocal Agreement and delegate implementation authority to the County Administrator.
Motion B. In accordance with Sections 21.47(a) and 21.31.b.2 of the Broward County Procurement Code, Commission approval is required for agreements exceeding the applicable monetary thresholds. Commission action is required to approve the ISC Agreement and delegate implementation authority to the County Administrator.
What Action Accomplishes
Motion A. Approves the Interlocal Agreement among Broward, Miami-Dade, Monroe, and Palm Beach Counties to provide cost-share support for services for the Southeast Florida Regional Climate Change Compact, at no additional cost to the County beyond the amount committed in Motion B.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.
This item supports the County Commission’s Value of Collaborates, “building partnerships and working collaboratively with others to meet shared objectives,” and the County Commission’s Goal of Resilient Community, “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection;” through continued support for collaboration and advancement of shared efforts as part of the Southeast Florida Regional Climate Change Compact (“Compact”).
The Compact was formally ratified in early 2010 through joint actions by the Broward, Palm Beach, Miami-Dade, and Monroe County Commissions (“Partner Counties”) as a voluntary collaboration focused on addressing shared climate challenges. In the first years of the Compact, grant funding supported program administration via the Institute of Sustainable Communities (“ISC”).
As grant dollars were incrementally reduced, the Partner Counties each committed to provide cost share funding to maintain the programmatic support of ISC. The County agreed to serve as the fiscal agent for the Compact, with the County to manage the contract services agreement with ISC and the Interlocal Agreement with each of the Partner Counties, to include quarterly invoicing for each partner’s respective cost share.
The initial Interlocal Agreement formalizing this collaboration was approved by the Commission on June 7, 2016 (Agenda Item No. 34) along with approval of the companion agreement between Broward County and ISC. A subsequent two-year agreement with ISC was approved by the Commission on January 10, 2017 (Agenda Item No. 12), followed by a three-year continuation agreement approved on March 20, 2018 (Agenda Item No. 17). A First Amendment to the Interlocal Agreement and the Agreement with ISC was approved by the Commission on March 10, 2020 (Agenda Item No. 27), which increased the annual contribution amount from each of the Partner Counties and to ISC.
On January 12, 2021, (Agenda Item No. 18) the Commission approved a new three-year Interlocal Agreement and companion Agreement with ISC, providing for the continuation of cost share support and ISC services for Fiscal Years 2021-2024, respectively. On September 7, 2023 (Agenda Item No. 23), the Commission approved a continuation of the three-year Interlocal Agreement and companion Agreement with ISC through January 31, 2027, and increased the maximum amount not-to-exceed compensation from $1,100,000 to $2,300,000. On January 22, 2026 (Agenda Item No. 51), the Commission approved a second amendment to reduce the term of the Interlocal Agreement and Agreement with ISC to end on September 30, 2026 (amended from January 31, 2027), and to pay a not-to-exceed amount of $245,000 in the amended renewal term. This modified term and funding was undertaken to account for budgetary circumstances that necessitated immediate adjustment with the commitment of partners to review funding and contract scope for the next contract term.
Since the execution of the Second Amendment, the Partner Counties have coordinated with ISC to streamline the services rendered by ISC for this next 3-year term, to better align with current priorities and available funds, as committed by each of the Partner Counties in the approved companion ILAs.
The Compact’s ongoing success and need for continued funding to support ISC’s role in project management and administration are the bases for the Interlocal Agreement, with Palm Beach, Miami-Dade, and Broward Counties to each contribute $95,000 per year and Monroe County to contribute $10,000 per year for Fiscal Years 2027-2029.
All three Partner County Commissions have approved the ILA (Exhibit 1) as of July 21, 2026.

Fiscal Impact/Cost Summary
The fiscal impact to the County is an annual contribution of $95,000 in Fiscal Years 2027, 2028, and 2029, for a total Broward County cost share of $285,000 toward the Compact’s total three-year cost of $885,000. The remaining $600,000 will be funded by Miami-Dade and Palm Beach Counties, each contributing $95,000 annually, and Monroe County, contributing $10,000 annually. Broward County’s annual contributions will be budgeted in the Natural Resources Contract Funds for Fiscal Years 2027, 2028, and 2029.
