Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE BROWARD ADDICTION RECOVERY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This action supports the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” Adoption of this Resolution approves a standard form for nonfinancial collaborative agreements enabling the Broward Addiction Recovery Division (“BARC”) to offer additional supportive services to certain Broward County social services clients.

BARC provides community-based substance use disorder and co-occurring disorder treatment services, including detoxification, assessment, residential level II treatment, medication-assisted treatment, outpatient, intensive outpatient, and primary healthcare services, to eligible adult residents in Broward County.

BARC has served adults with substance use disorders for over 50 years and has developed relationships with external community service agencies that identify and aid individuals in need of services. Nonfinancial collaborative agreements will set forth each party’s roles and responsibilities as well as the obligations of each party in accordance with 42 C.F.R. Part 2 (Confidentiality of Substance Use Disorder Patient Records), the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Health Information Technology for Economic and Clinical Health Act (HITECH), and related regulations.

This Resolution (Exhibit 1) will approve the terms of a standard form for nonfinancial collaborative agreements in substantially the form set forth in Attachment A and will authorize the HSD Director or Deputy Director to execute the individual agreements on behalf of Broward County. The Office of the County Attorney will review the individual agreements for legal sufficiency prior to execution. Any material changes to the standard form will require approval by the Commission.
