Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47(a), the Broward County Board of County Commissioners (“Board”) shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action approves the First Amendment to the Agreement between Broward County (“County”) and Saltz Michelson Architects, Inc. (“Agreement”).
On February 22, 2022 (Item No. 50), the Board approved three agreements for professional consultant services for building projects at Broward County’s Fort Lauderdale-Hollywood International Airport (“FLL”) and North Perry Airport (“HWO”), for an initial three-year term, with two one-year renewal terms. Each agreement was for the maximum not-to-exceed amount of $5,000,000, which included reimbursables in the amount of $250,000. Motion A approved the Agreement between the County and Justin Architects, PA (formerly Cartaya and Associates Architects, P.A.), Motion B approved the Agreement between the County and Saltz Michelson Architects, Inc. (“Saltz”), and Motion C approved the Agreement between the County and ACAI Associates, Inc (“ACAI”).
On March 27, 2024, ACAI permanently closed for business and abruptly withdrew services for all existing and future projects with the Broward County Aviation Department (“BCAD”), leaving $4,300,000 available in uncommitted funds under their Agreement. As a result of ACAI’s cessation of business, it is necessary for BCAD to redistribute the uncommitted funds to the two remaining firms available under the agreements, Saltz and Justin Architects, PA, to complete existing and future planned work.
In addition to ACAI’s cessation of business creating a shortfall in consultant coverage, BCAD has since determined that there is a need for additional projects and more extensive work than initially anticipated. These critical projects include the Building Safety Inspections Program, Terminal 3 Air Handlers Replacement, Terminal 1 Concourse B Slab Repairs, and Terminals 2 and 3 Electrical and Structural Repairs, which are necessary for BCAD and will enhance operations at FLL.
Saltz provides consultant services to perform pre-design, design, construction administration, and resident project representative services for new building construction, modifications, alterations, and improvements to existing structures that are landside and airside at FLL and HWO.
The Office of Economic and Small Business Development established a County Business Enterprise ("CBE") goal of 30% for this project. Saltz committed to 45% CBE participation. To date, Saltz has been paid $1,032,213, and has paid CBE firms $436,434, for 42.28% participation (Exhibit 2).
The proposed First Amendment will provide funding for continued consultant services, increasing labor by $4,000,000, from $4,750,000 to $8,750,000, with no change to the reimbursable amount of $250,000, for a revised total Agreement amount of $9,000,000, and update certain terms in the Agreement.
The proposed First Amendment has been reviewed and approved as to form by the Office of the County Attorney.
