(Commission District 8)

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT (EPGMD) AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION (EEPD) RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This action supports the Board’s value encouraging investments in renewable energy, sustainable practices and environmental protections: Goal 1: Seek funding for, implement policies and pursue projects promoting the use of alternative energy, resource conservation, sustainable practices and environmental protection. Resource conservation and environmental protection is achieved by ensuring that the mitigation area will remain wetlands in perpetuity.
The EPGMD issued Environmental Resource License (ERL) DF18-1101 (Exhibit 3), to SAFStor Pines, LLC authorizing impacts to 7.5 acres of wetlands and requiring the licensee to provide 1.97 acres of mixed habitat wetland mitigation area which included the enhancement and restoration of 1.64 acres of wetlands and 0.33 acres of surface water buffers on site related to the development of a storage facility (Exhibit 1), and convey a Conservation Easement (Exhibit 2) to the County over the on-site wetland mitigation area to ensure it would remain in perpetuity. Additional mitigation was provided through the purchase of 2.98 credits from the FPL/Everglades Mitigation Bank.
The EPGMD also recommends approval of the Cash Bond Agreement (Exhibits 4 and 5), which was provided as fulfillment of requirements to receive the Environmental Resource License. The cash bond is a financial assurance mechanism, to help ensure that the license holder preforms the construction, maintenance and monitoring of the mitigation area, as required by the license. If construction, maintenance and monitoring of the mitigation are satisfactorily completed in accordance with the license, the bond will be released. If not, the County can draw on the bond, as needed, to complete the mitigation requirements. The Cash Bond in the amount of $134,620 was deposited into account 001-023-WET1-2200.
