MOTION TO ADOPT Resolution, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, URGING MUNICIPALITIES WITHIN BROWARD COUNTY, FLORIDA, TO ENACT AN ORDINANCE PERTAINING TO SPEED DETECTION SYSTEMS IN SCHOOL ZONES; DIRECTING THE COUNTY ATTORNEY’S OFFICE TO AMEND THE COUNTY’S REVOCABLE LICENSE AGREEMENT FORM TO REQUIRE MUNICIPALITIES TO IMPLEMENT CERTAIN BALANCED MEASURES WITHIN A COUNTY RIGHT-OF-WAY IN CONNECTION WITH A MUNICIPAL ORDINANCE PERTAINING TO SPEED DETECTION SYSTEMS IN SCHOOL ZONES; DIRECTING THE COUNTY ADMINISTRATOR TO TRANSMIT A COPY OF THIS RESOLUTION TO EACH MUNICIPALITY LOCATED WITHIN BROWARD COUNTY, FLORIDA; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

Summary Explanation/Background
The Board of County Commissioners of Broward County, Florida (“Board”), will hold a public hearing on April 22, 2025, to consider enacting an Ordinance authorizing the use of speed detection systems to enforce school zone speed limits within the Broward County Municipal Services District (“BMSD”). The proposed Ordinance contains provisions that (i) limit the use of speed detection systems to school zones that have flashing beacons; (ii) limit enforcement to those times when the beacons are flashing; and (iii) require the placement of speed detection systems a minimum of one hundred (100) feet from any point of ingress to a school zone (“Balanced Measures”).
While Section 336.1896, Florida Statutes, limits the County’s regulatory authority to authorize speed detection systems to the BMSD, the Board is desirous of encouraging municipalities within the County to enact similar ordinances within their jurisdictions, using the County’s ordinance and its Balanced Measures as a model. The Resolution also directs the County Attorney’s Office to amend the County’s Revocable License Agreement form to authorize the placement or installation of speed detection systems within County rights-of-way only where the placement, installation, and enforcement is consistent with the Balanced Measures. Finally, the Resolution further directs the County Administrator to transmit a copy of the Resolution to each municipality within the County.
