Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Commission's Healthy Community goal of cultivating community culture, arts, recreation and life-long learning.

 

The Parks and Recreation Division offers a free Broward County Neighborhood Parks Afterschool Program at parks within the Broward Municipal Services District for children countywide. In collaboration with the CSC, the County will plan, manage, host, and provide staff for the Lights On Afterschool community-wide event that will be held on October 14, 2024, at Franklin Park. The CSC will reimburse the County for services or other deliverables provided, up to $17,500. This event will be one of over 8,000 rallies being held as part of the annual nationwide Lights On Afterschool event hosted by The Afterschool Alliance to celebrate afterschool programs. Over 1,000 Broward County children, elementary to high school-aged, are expected to attend and participate in program activities such as sports, book giveaways, arts and crafts, performing arts, and free lunch.

 

The services to be provided by the County’s Lights on Afterschool event, through Broward County Parks and Recreation Division, are specified in Exhibit A - Scope of Work to the Agreement. This event will call attention to the importance of afterschool programs.

 

The agreement is on a form prepared by the CSC and incorporates some recommended changes requested by the County. The CSC is providing funding to the County and has requested the County execute the agreement first. The CSC form agreement includes certain non-standard provisions, including the County’s obligation to indemnify the CSC for intellectual property infringement claims and a cross-indemnification provision relating to claims for violation of privacy rights (including for alleged violations of the Family Educational Rights and Privacy Act). The agreement provides for an initial one-year term, with four, optional, one-year renewal terms upon mutual agreement, which may be exercised by the County Administrator on behalf of the County.
