Motion A: Board of County Commissioners’ approval is required to grant an interest in real property.

 

Motion B: Board of County Commissioners’ approval is required to execute a Bill of Sale.

 

What Action Accomplishes

Motion A: Provides the City of Coconut Creek with a utility easement to install, construct, operate, maintain, repair, replace and/or reconstruct a water distribution system which services Tradewinds Park.

Previous Action Taken

On June 4, 2013 (Item No. 14), the Board (i) approved an Utility Easement granting the City of Coconut Creek a 12-foot-wide easement for the construction, installation, reconstruction, replacement, repair, operation, distribution and maintenance of a water distribution system, wastewater collection system and all appurtenances to service Tradewinds Park, and (ii) approved a Bill of Sale transferring ownership of the water distribution system, waste water collection systems and related facilities and systems to the City of Coconut Creek.

 

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT, THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION, AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Board of County Commissioners’ Goal of “consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work and visit.”

 

Motion A: The City of Coconut Creek (“City”) provides water services to Tradewinds Park and requires the utility easement. The 12-foot-wide utility easement to be granted to the City provides for the installation, construction, operation, maintenance, repair, replacement and/or reconstruction of a water distribution system and all appurtenances relative to the system to service Tradewinds Park located at 3601 West Sample Road in the City of Coconut Creek.

 

In 2013, Broward County (“County”) transferred ownership of a water distribution system to the City. That existing system is now connected to, and extended by, a new water distribution system, which the County installed in order to provide enhanced fire protection (including new fire hydrants along main roadways), and additional general water service further into Tradewinds Park.

 

Motion B: Pursuant to the City's Code of Ordinances, Section 13-169.4, when the City provides water services to a property, the City requires the transfer of ownership, by Bill of Sale, of the complete on-site water distribution system. The Bill of Sale will transfer ownership of the County-installed water distribution system in Tradewinds Park to the City.

 

The Utility Easement Agreement and the Bill of Sale have been reviewed and approved as to form by the Office of the County Attorney.
