Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The vacant parcel of land is identified by Folio No. 5140-16-00-0037, approximately 19,204 square feet, and located at SW 4 Street in the City of Pembroke Pines, Florida (“Property”). The Property is zoned PUD, Planned Unit Development under the City of Pembroke Pines zoning codes and deemed unbuildable.  The Broward County Property Appraiser assesses the Property’s value at $321,670.

The County acquired this Property by Warranty Deeds as recorded on June 4, 1970, in Official Records Book 4225, Page 435, Official Records Book 4225, Page 437, and Official Records Book 4225, Page 439, all the Official Records of Broward County.

All applicable Broward County agencies were solicited for potential County use of this Property or rights therein, and no current or future use was identified. Staff has determined that the Property is no longer needed for County use because it is not buildable on its own and is bifurcated by a road that provides access to the Golf Manor community.

Pursuant to Florida Statutes, Section 125.35(2), "When the board of county commissioners finds that a parcel of real property is of insufficient size and shape to be issued a building permit for any type of development to be constructed on the property... and when, due to the size, shape, location, and value of the parcel, it is determined by the board that the parcel is of use only to one or more adjacent property owners, the board may effect a private sale of the parcel” by sending notice of its intent to sell the parcel to the adjacent property owners and accepting sealed bids from such property owners if two or more adjacent property owners notify the board of their desire to purchase the parcel. Pursuant to Florida Statutes, Section 125.35(2), the Board of County Commissioners (“Board”) may, after sending notice of its intended action to owners of adjacent property by certified mail, effect a sale and conveyance of the Property at private sale without receiving bids or publishing notice. If two or more adjacent property owners notify the Board of their desire to purchase the Property, the Board may convey the Property to the highest bidder or may reject all offers after receiving bids from the adjacent property owners. In the event no adjacent owner submits a bid to purchase the Property, staff recommends a private sale. To that effect, the County’s Real Property and Real Estate Development Division will post the Property on its website and will send the link to the website to all those who have expressed interest in acquiring County property, currently registered in the Surplus Distribution List. The Board will retain the authority to reject all bids in the event they are too low. The Board must approve any sale of the Property pursuant to bids received by adjacent property owners or to offers to purchase the Property received in response to the Property’s advertisement on the Real Property and Real Estate Development Division’s website.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
