Why Action is Necessary
In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards and authorize the execution of the associated contracts with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.
Additionally, in accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service large hub airport in excess of $1,500,000 as a separate line item on the agenda and must provide a reasonable opportunity for public comment. Such contracts may not be approved, awarded, or ratified as part of a consent agenda.
In accordance with Section 332.0075(3)(a) Florida Statutes, purchases of commodities or contractual services by a commercial service large hub airport must be made through competitive sealed bids, proposals, or replies, unless an exception consistent with Section 287.057(3), Florida Statutes, applies.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
If ratified, this item authorizes Schindler Elevator Corporation (Schindler) to modernize and replace the elevators and escalators in Terminal 1 at Fort Lauderdale-Hollywood International Airport (FLL). The project, part of the County’s ongoing airport infrastructure improvement program, is structured as a fixed-price construction contract totaling $7,413,574. The scope includes equipment modernization, installation, testing, and related services to enhance passenger safety, reliability, and operational efficiency.
This action also formally designates Schindler as the single-source provider for these services in accordance with Sections 287.057(3)(c), Florida Statutes, as incorporated by Section 332.0075(3)(a), Florida Statutes, which is applicable to commercial service large hub airports.
On June 10, 2025 (Item No. 38), the Board authorized the County Administrator to execute procurement-related actions during the 2025 Summer Recess. Pursuant to that authority, on July 29, 2025, the County Administrator approved a Sole/Reasonable Source designation in accordance with Section 21.25(a) of the Broward County Procurement and executed the agreement with Schindler for the Terminal 1 Elevators and Escalators Replacement project at FLL (Exhibit 1).
Under Section 21.25(a) of the Broward County Procurement Code, the County may conduct a Sole/Reasonable Source procurement when only one source or one reasonable source is capable of providing the required goods or services. For airport procurements governed by Section 332.0075(3)(a), Florida Statutes, all contracts exceeding the state threshold must comply with Chapter 287 procurement procedures, including the single-source exception in Section 287.057(3)(c), Florida Statutes. The County’s Sole/Reasonable Source process, which requires written justification, public posting, an opportunity for vendor response, and approval by the Board, satisfies the state’s single-source procedural requirements, ensuring full compliance with Sections 287.057(3)(c) and 332.0075(3)(a)(b), Florida Statutes.
On October 15, 2025, the Purchasing Division issued a Notice of Intended Decision to enter a single-source contract in a manner consistent with state law. No protest was received. Based on this information, the Director of Purchasing recommends approval of this single-source designation.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount.
