Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/ REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The School Board of Broward County (“SBBC”) is in the process of making improvements, including the replacement of buildings, at James S. Rickards Middle School located at 6000 NE 9th Avenue in Oakland Park, Florida (“SBBC Property”). Adjacent to the SBBC Property is a Broward County (“County”) owned vacant parcel (Folio No. 494211000401) located at NE 9th Avenue in Oakland Park, Florida (“Property”).
The Property is considered an asset of the Water and Wastewater Utility System (the “Utility”) and as such is subject to the conditions of Resolution No. 88-4066, adopted by the Broward County Board of County Commissioners (the “Board”) on September 6, 1998, as amended and supplemented (the “Bond Resolution”). Under Section 715(c) of the Bond Resolution, the County is permitted to sell, lease, or otherwise dispose of any assets forming part of the Utility if the Board, by resolution, declares that such assets are not needed or serve no useful purpose in connection with the maintenance and operation of the Utility. The Property is vacant and is not needed for County or Utility purposes during the time that SBBC has requested for use of the Property.
The proposed Resolution, attached as Exhibit 1, approves the Agreement between Broward County and the School Board of Broward County for Temporary Use of County Property (Exhibit 2).
The initial term of the Agreement commences on the date it is fully executed by the parties and expires on August 31, 2025.
The proposed Resolution and the Agreement have been reviewed and approved for legal sufficiency by the Office of the County Attorney.
