Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Broward County (“County”) is the owner of the Property identified by Folio No. 4842-21-12-0050. The Property is approximately 22 acres in size and is located at Blount Road, north of West Copans Road, in the City of Pompano Beach, Florida. The Property is zoned general industrial, I-1/PCI - planned industrial overlay, under the City of Pompano Beach zoning code.
In June 2015, the County and certain municipalities located within the County entered into a Settlement Agreement resolving litigation styled City of Sunrise, et al. v. Broward County, Seventeenth Judicial Circuit Court Case No. CACE-13-015660, relating to the 1986 Interlocal Agreement for Solid Waste Disposal Services. The Settlement Agreement, as amended (“Settlement Agreement”), governs, among other matters, the sale of the Property. Pursuant to the Settlement Agreement, the County and the municipalities must use their best efforts and take all reasonable steps to sell the Property. The County and the municipalities jointly extended the deadline to commence the sale process to October 11, 2026. The Settlement Agreement requires the County to conduct the sale process by sealed competitive bid to the highest responsive and responsible bidder, with input regarding the solicitation specifications from the Mayors of Fort Lauderdale, Hollywood, Miramar, Sunrise, and Weston, and in accordance with Section 1-4 of the Broward County Code of Ordinances and applicable Florida law.
The proposed Resolution determines that the Property is no longer needed for County purposes and that disposition of the Property in accordance with the Settlement Agreement, Section 1-4 of the Broward County Code of Ordinances, Section 125.35, Florida Statutes, and applicable law is in the best interest of the County. The Resolution authorizes the Real Property and Real Estate Development Division to commence and manage the sale process by sealed competitive bid to the highest responsive and responsible bidder, including obtaining the input regarding the solicitation specifications required by the Settlement Agreement and providing all notices required by applicable law. Following completion of the applicable competitive-bid process, the proposed sale of the Property or other action authorized by the Settlement Agreement will be presented to the Board for consideration and approval as required under Section 125.35, Florida Statutes. The Resolution does not constitute approval of a purchaser, purchase and sale agreement, quitclaim deed, or sale of the Property.
