Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnership and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) participation goal of 25% for this agreement. CPZ Architects, Inc. (“CPZ”) has committed to a 40% CBE participation, which has been reviewed and approved by OESBD. As part of the negotiations for the Third Amendment, CPZ has agreed to continue with the same subconsultants and a total CBE participation commitment of 40%. To date, CPZ Architects, Inc. has achieved a 61.41% participation rate and has provided a CBE utilization forecast to OESBD to meet its CBE commitment (see Exhibit 2).
On August 2, 2019, the County Administrator approved the original deliberately phased Agreement with CPZ to design a new Facilities Maintenance Building complex in the Northport area of Port Everglades, with a maximum not-to-exceed amount of $495,000 for Basic Services, and a maximum not-to-exceed amount of $70,000 for Reimbursable Expenses. On May 18, 2020, the Director of Purchasing approved the First Amendment to the Agreement, increasing the maximum not-to-exceed amount from $495,000 to $532,995 for Basic Services, and increasing the maximum not-to-exceed amount from $70,000 to $73,190 for Reimbursable Expenses. On May 24, 2022 (Item No. 7), the Board approved the Second Amendment to the Agreement, increasing the maximum not-to-exceed amount from $532,995 to $3,866,666 for Basic Services, increasing the maximum not-to-exceed amount from $73,190 to $419,520 for Reimbursable Expenses, and adding $310,000 for Optional Services.
The Third Amendment to this deliberately phased Agreement will continue to provide for professional Consulting Services to support the design and construction of the Consolidated Facilities Maintenance Building for the Port Everglades Department. Due to operational needs of the Convention Center & Hotel Expansion Project, the original site that was in the Northport area of the Port adjacent to the existing Facilities Maintenance buildings is now needed for a new truck marshalling area and parking facility to support the expanded Convention Center. As such, the Port’s facility will now require relocation to the Midport area of Port Everglades adjacent to the Cruise Terminal 29 site.
Currently, the Facilities Maintenance Division staff and trade maintenance personnel are located within various buildings throughout the Port, and this project will consolidate the Division functions into a central location. The new location for this facility is east of S.E. 19th Avenue and west of Cruise Terminal 29 on property currently being used for vehicle, container, and break-bulk cargo storage. The new project site will accommodate three new buildings, including a two-story Facilities Maintenance building, a single-story Warehouse/ Storekeepers building, and a combined dual-purpose one-story building for the Port’s linehandlers and crane maintenance storage. In addition to the professional services for these buildings, ancillary offsite work will be necessary to support this development, including a new dedicated right turn lane from Eller Drive to southbound SE 19th Avenue, traffic signalization improvements, new pedestrian walkways leading to Cruise Terminal 29, new two-lane road widening, upgrades to retaining walls, and improvements to utilities and drainage infrastructure.
Additionally, the Third Amendment updates the maximum hourly rates contained in Exhibit B of the Agreement for CPZ’s subconsultants and adds a Resident Project Representative, Special Inspector, and Welding Inspector positions, along with updates to the Exhibit B-1 reimbursable rates to align with current market rates associated with the various direct non-salary expenses. Finally, the Third Amendment adds miscellaneous provisions to cover new federal, state, and local requirements.
One meeting was held on August 8th, 2024, to negotiate this Third Amendment to the Agreement. This meeting was attended by representatives from CPZ, Keith, Terracon, MUE, DMS, Delta Engineers as well as the County Attorney’s Office and Port staff from the Seaport Engineering & Construction Division.
This Third Amendment to the Agreement has been reviewed and approved as to form by the Office of the County Attorney.
