Why Action is Necessary

Broward County Board of County Commissioners (“Board”) approval is required for the execution of the PTGA and to appropriate grant revenue not anticipated in the budget.

 

What Action Accomplishes

Execution of the PTGA provides state funding to purchase cybersecurity-related equipment for buildings throughout Port Everglades. The County Administrator is also authorized to take the necessary administrative and budgetary actions to implement the PTGA and to approve any future amendments to the PTGA that do not increase the County’s local match percentage greater than 25%.  Finally, the action provides the one-time local match and accepts unanticipated grant revenue to fund the project.

Summary Explanation/Background

On March 12, 2026, the Florida Department of Transportation (FDOT) approved the allocation of state funding for seaport security initiatives at Florida seaports. The allocation included $112,395 in grant funding for Port Everglades (“Port”) to purchase equipment to house computer cybersecurity hardware throughout the Port to increase the physical security of the hardware and limit access to authorized County staff. The grant funding will also support the port’s efforts to comply with new US Coast Guard cybersecurity requirements though upgrades to security hardware and software to increase protection of the security network and improve performance and reliability. 

 

A requirement for this funding is for the County to execute this PTGA between FDOT and Broward County prior to execution by FDOT and disbursement of any funding. This PTGA is written in the standard FDOT format, except for the following clauses that were omitted (as indicated by strikethroughs): (1) “… to the extent permitted by law and as limited by and pursuant to the provisions of Section 768.28, Florida Statutes, the Agency shall indemnify, defend, and hold harmless the State…”; and (2) “Nothing contained in this paragraph is intended to nor shall it constitute a waiver of the Department’s or the Agency’s sovereign immunity.” Notwithstanding the disclosures provided in this paragraph, the PTGA has been reviewed and approved for legal sufficiency by the Office of the County Attorney.
