Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The referenced Agreement provides for the construction of the Port Everglades By-Pass Road on Spangler Boulevard from Miami Road to Eisenhower Boulevard and Eisenhower Boulevard from Spangler Boulevard to North of SE 20th Street. The Agreement amount is $48,073,740.
Pursuant to Section 21.56 of the Broward County Procurement Code, the Board is required to approve any change order allowance that exceeds 5% of the total contract amount. Section 21.56 further provides that the Contract Administrator may only approve change orders within the budgeted allowance up to $250,000.
This item provides the Director of the Public Works Department (Director) the authority to approve change orders up to 10% of the original contract amount and approve individual change orders up to $500,000. This action applies only to Agreement No. TRN2127156C1, Construction of Port Everglades By-Pass Road.
The Convention Center Expansion and Headquarter Hotel opening is contingent on the completion of the Port Everglades By-Pass Road. This action allows the Director to mitigate against the potential high cost of delays for events which are beyond the reasonable control of the Contractor and that would otherwise impede the mutually agreed to critical path on the approved baseline schedule for the Port By-Pass Road construction. The proposed action provides an efficient and expedient management of the construction work to allow the opening of the Port By-Pass Road as scheduled.
