A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners (“Commission”) at its meeting of May 26, 2026.

Summary Explanation/Background

The Broward County Tree Preservation Trust Fund (“Trust Fund”) was established with the stated purpose of accepting and disbursing contributions made to the County as part of tree removal licenses and monies deposited with the Public Works and Environmental Services Department (“PWESD”) for tree preservation purposes. Trust Fund monies are to be used to enhance tree canopy coverage in the County. Section 27-413 of the Broward County Code of Ordinances authorizes Trust Fund expenditures and disbursements for the planting of trees on public lands, at childcare facilities that meet applicable criteria, as part of affordable housing project tree mitigation, and for certain projects supported or undertaken by the PWESD. The proposed Resolution amends Section 31.99 of the Administrative Code to provide the County Administrator with authority to execute agreements for Trust Fund monies for non-PWESD projects, in a form that has been approved by the County Attorney’s Office, where the funding amount does not exceed $20,000.

 

The proposed Resolution also creates Part XLIII in Chapter 31, Section 31.123, of the Administrative Code authorizing the County Administrator to approve interlocal agreements with municipalities, in a form approved by the County Attorney’s Office, where the County’s Building Code Division is providing the municipalities with services related to building, zoning, code enforcement, or the County Unsafe Structures Board. The costs of providing the Building Code Division services are recovered from the applicable permit fees or are invoiced to the municipalities after the services have been performed.

 

The form agreements for Trust Fund disbursements and Building Code Division services, which the Resolution requires must be approved for legal sufficiency by the County Attorney’s Office, will be provided to the Commission for informational purposes under separate memorandum from the County Attorney’s Office.
