THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This agenda item supports Broward County Board of County Commissioners Strategic Plan that promotes "A Pristine, Healthy Environment" by encouraging stewardship of the environment. Broward County Water and Wastewater Services (WWS) recommends amending Chapter 34, "Water and Sewer" of the Broward County Code of Ordinances (Code) to ensure consistency with recent amendments to the Florida Administrative Code (F.A.C.) Rule 62-625 and the federal Pretreatment Streamlining Regulations at 40 Code of Federal Regulations (CFR) Part 403.
The Florida Department of Environmental Protection (FDEP) directed Broward County to revise its Sewer Use Ordinance (SUO), as codified in Chapter 34 Article VI, of the Broward County Code of Ordinances, to reflect the regulatory changes from the State. To comply with FDEP’s directive, WWS staff has proposed revisions to the SUO and submitted the proposed Ordinance to FDEP for review on May 20, 2025.
On June 17, 2025, WWS received preliminary written approval for the Revised Sewer Use Ordinance from FDEP. WWS was advised to schedule the SUO for formal adoption by the Board of County Commissioners. Following final adoption of the Ordinance, the SUO must be submitted to FDEP as a substantial program modification in accordance with Rule 52-625.540, F.A.C. FDEP will then initiate a formal review of the program modification in accordance with Rule 62-625.510, F.A.C.
