Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.42.(j), Procedures for RFPs, RLIs, and RFQs, if an objection or protest has been filed with respect to an Evaluation Committee’s ranking, the ranking must be submitted to the Board for final approval. The Board, by majority vote, may (1) accept the ranking as final; (2) reject all responses to the solicitation; or (3) direct the Evaluation Committee to reconvene to consider any new or additional information the Board directs the Evaluation Committee to consider. In addition, the Board may request presentations by the ranked vendors and may, by supermajority vote, rerank those vendors in a final ranking.

 

What Action Accomplishes

Approves the Evaluation Committee’s recommendation of the final ranking of qualified firms for Group 2 only.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) designated Group 2, Rental Car Center (RCC), as a reserve opportunity for County Business Enterprise (CBE) firms. Sunshine Cleaning Systems, LLC d/b/a Pritchard Industries (Sunshine) is not a certified CBE firm; however, Sunshine committed to 30% CBE goal participation, in accordance with the Broward County Business Opportunity Act (BOA) (Exhibit 2). In addition, this procurement is subject to the Broward County Workforce Investment Program.

 

This project provides comprehensive janitorial service: Group 1 is for services at the Broward County Aviation Department’s Terminals 1 - 4 and Airport Operation Control Central (AOCC); Group 2 is for services at RCC. Group 1 and Group 2 were solicited concurrently but evaluated and ranked separately.

 

On March 18, 2025, Request for Proposals (RFP) No. BLD2128700P1, Janitorial Services for Terminals 1 - 4, AOCC, and RCC at FLL, was advertised. At the time of the May 16, 2025 submittal deadline, 21 firms submitted proposals (11 for Group 1; 16 for Group 2).

 

On September 5, 2025, an Initial Evaluation Committee (EC) meeting was held to determine responsiveness and responsibility of proposing firms. The EC determined nine firms for Group 2 were both responsive and responsible to the RFP requirements.

 

On September 26, 2025, a Final EC meeting was held. After presentations, evaluation, questions and answers, scoring, and ranking, the EC named Sunshine as the first-ranked firm for Group 2 (Exhibit 1).

 

On October 6, 2025, the Director of Purchasing received a preemptive objection letter for Group 2 from McKenzie’s Cleaning Inc. (McKenzie). The objection letter claimed the Evaluation Committee’s ranking placed a non-CBE prime contractor above the two certified CBE firms, inconsistent with the CBE Reserve Program requirements (Exhibit 3).

 

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from October 9 - 13, 2025, which provided an opportunity for any proposer or interested party to object and present any new or additional information regarding the responsibility of the proposers.

 

On October 30, 2025, the Director of Purchasing issued a response to McKenzie’s objection letter, stating that the objection did not meet the criteria under Section 21.42 of the Procurement Code, as the information cited was already known to the Evaluation Committee. Furthermore, while McKenzie met the monetary differential under Section 1-81.3(f)(1) of the Code for Group 2, McKenzie did not meet the points differential also required by Section 1-81.3(f)(2) of the BOA, and therefore McKenzie is not eligible to become the No. 1 ranked firm. The evaluation and scoring of firms were conducted appropriately and within the established guidelines, practices, and procedures set forth in the Broward County Procurement Code, Ordinances, and existing written guidelines. As such, the objection was denied (Exhibit 4).

 

The EC’s final recommendation of ranking was posted on the Purchasing Division website from October 30 - November 6, 2025, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.

Group 1 recommendation of ranking will be submitted subsequently, after objections and/or protests are resolved.
