Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a rejection of apparent low bidder.

 

What Action Accomplishes

Provides for the fiber optic cable installation and intersection improvements located along four different roadway segments in the cities of Coral Springs, Tamarac, Weston, Sunrise, Davie and Plantation.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Connected Community Goal, “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) contract goal of 30%. Arc Electric, Inc. (Arc Electric) committed to 30% CBE participation, which has been reviewed and approved by OESBD (Exhibit 3).

 

This Agreement provides for the installation of fiber optic cable and intersection improvements along four different roadway segments: 1. Pine Island Road from McNab Road to Royal Palm Boulevard in the Cities of Coral Springs and Tamarac; 2. Coral Springs Drive from Royal Palm Boulevard to Wiles Road in the City of Coral Springs; 3. SR84 from Weston Road to NW136 Avenue in the Cities of Weston, Sunrise, and Davie; 4. NW136 Avenue from SR84 to Sunrise Boulevard in the Cities of Sunrise and Plantation.

 

This procurement carries a 100% performance and payment guaranty. The vendor has provided a bid guaranty obligating the vendor to provide requisite performance and payment guaranty, upon notice of award.

 

The Agreement includes allowances in the amount of $15,000. Expenditures under the allowances must be approved by the Contract Administrator and will be reimbursed at the vendor’s actual cost without mark-up (Exhibit 2).

 

The Director of Purchasing has determined the apparent low bidder, Bore Tech Utilities and Maintenance, Inc., to be non-responsive to the Licensing Requirements bid requirements.

 

Highway Construction and Engineering Division has reviewed the bid submitted by Arc Electric and concurs with the recommendation for award (Exhibit 4).

 

No County vendor performance evaluations have been completed for Arc Electric.

 

The Purchasing Division reviewed the prices submitted by the low responsive, responsible bidder, Arc Electric, and has determined that the prices submitted are fair and reasonable based on price analysis (Exhibit 5).

 

The bid was advertised on April 16, 2026, and opened on May 22, 2026; six bids were received with one declination (Exhibit 2).

 

The Recommendation for Award was posted on the Purchasing Division website. There was no protest filed against this procurement.

 

Arc Electric’s bid validity expired on September 19, 2026, and Arc Electric has agreed to extend it through November 18, 2026.

 

The proposed Agreement is Exhibit 1.
