Why Action is Necessary

MOTION A: In accordance with the Domestic Partnership Act, Section 16½-157(c)(8) of the Broward County Code of Ordinances, the Board is authorized to waive the Domestic Partnership Act requirements in the best interest of the County.

 

MOTION B: In accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

 

What Action Accomplishes

Provides all labor, materials, equipment, services and incidentals to furnish diesel exhaust fluid for the Broward County Transportation Department and other County agencies that may have need of these services and products.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND THE APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) determined that no County Business Enterprise (CBE) participation goal should apply to this solicitation based on its review of the products and services requested and availability of CBE firms to perform the services (Exhibit 2).

 

Motion A seeks to waive the requirements of the Broward County Domestic Partnership Act, per Section 16½-157(c)(8) of the Code of Ordinances, in order to award this solicitation to Reladyne Florida, LLC. Pursuant to the Domestic Partnership Act, Section 16½-157(c)(8), the Board is authorized to waive the Domestic Partnership Act requirements in the best interests of the County. Reladyne Florida, LLC submitted a letter requesting a waiver of the applicable Domestic Partnership Act requirements for this solicitation. Reladyne Florida, LLC indicated that the current company benefits plan is structured and aligned with federal and state guidelines with specific contractual relationships recognized under their insurance policy and that they are unable to extend benefits to their employee’s domestic partners as a result of existing plan constraints and insurance requirements (Exhibit 3).

 

Motion B provides for a contract for diesel exhaust fluid. The solicitation specified a basis for award of multiple awards, which provided for awards to be made to a maximum of two responsive, responsible vendors. The low responsive, responsible, vendor will be designated as the primary vendor; the second low responsive, responsible vendor will be designated as the secondary vendor. The secondary vendor will be issued purchase orders when the primary vendor is unable to perform or when the County determines its maximum service capacity has been reached, and additional service capacity is needed.

 

The Transportation Department has reviewed the bid submitted by Reladyne Florida, LLC (Primary) and concurs with the recommendation for the award (Exhibit 4). Five County vendor performance evaluations were completed for Reladyne Florida, LLC over the past five years. The vendor has an overall performance rating of 4.10 out of possible rating of 5.0. Copies of the vendor's performance evaluations are available upon request.

 

On August 15, 2025, the County Administrator approved the award of secondary vendor Palmdale Oil Company, LLC, in accordance with Agenda Item No. 38 on June 10, 2025, Board agenda.

 

The Purchasing Division reviewed the prices submitted by Reladyne Florida, LLC and has determined that the prices submitted are fair and reasonable when compared to the pricing offered from the other responses received and the pricing from the Independent Cost Estimate (Exhibit 5).

 

Incumbents: Reladyne Florida, LLC; Contract Number and Title: TRN2124163B1, Diesel Exhaust Fluids; Contract Term: April 21, 2022, through April 20, 2023; First Renewal: April 21, 2023, through April 20, 2024; Second Renewal: April 21, 2024, through April 20, 2025. A 90-day extension was granted to end the contract on July 19, 2025. Expenditures to date: $788,567.

 

The bid was advertised on June 10, 2025, and opened on June 27, 2025; six bids were received with one declination (Exhibit 1).

 

The Recommendation for Award was posted on the Purchasing Division website from August 6 - 13, 2025. There was no protest filed against this procurement.

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

 

The contract consists of the solicitation and the vendor’s response.

 

The initial contract period begins on date of approval, and terminates one year from that date, unless extended.

The open-end contract has an estimated amount of $519,591 over a potential three-year period. The funds estimated for the current fiscal year are included in the current Fiscal Year budget.
