Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the Board’s goal of ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.
The Resilient Environment Department (RED) issued ERL No. DF95-1014 to Reuter Recycling of Florida, Inc., on March 22,1995, requiring a Deed of Conservation Easement for a 29.0232-acre wetland mitigation area. The Deed of Conservation Easement was recorded on August 14, 1995, in Official Record Book 23786, at Page 989 in the Public Records of Broward County.
On June 27, 2007, Waste Management Inc. of Florida purchased Reuter Recycling of Florida, Inc., and assumed ownership and operation of the Reuters Recycling Composting and Transfer Station site located at 20701 Pembroke Road in the City of Pembroke Pines. On June 21, 2024, RED issued ERL No. DF22-1387 to Waste Management Inc. of Florida. Said ERL authorized 10.80 acres of wetland impacts for a proposed expansion of the Reuters Recycling Composting and Transfer Station and required a total wetland mitigation area of 51.706 acres. The ERL required 36.097 acres (of the 51.706 acres) of wetland mitigation to be encumbered by an Amended Deed of Conservation Easement (Exhibit 1), and the remaining 15.609 acres (of the 51.706 acres) to be encumbered by a Joint Deed of Conservation Easement to FDEP and Broward County (Exhibit 2). On July 19, 2024, the FDEP issued ERP No. 06-056057-010-EI to Waste Management Inc. of Florida, requiring a joint easement over the 15.609-acre area referenced above. The deeds of conservation easement ensure the wetland mitigation sites will remain in perpetuity and be maintained by the grantor.
The Amended Deed of Conservation Easement and the Joint Deed of Conservation Easement have been reviewed and approved as to form by the Office of the County Attorney.
