Why Action is Necessary

Motion A: In accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions; and Section 21.53, Duration of Contracts, the Board is required to approve all contracts for supplies or services of more than five years.

 

Motion B: In accordance with Broward County Procurement Code Section 21.19(a), Standardization, the Board is required to approve all standardizations above the award authority of the Director of Purchasing; and Section 21.19(c), the Director of Purchasing may recommend to the Board that any brand or source of goods or services be standardized as the sole brand or sole source of goods or services that will be purchased for a County Agency or countywide.

 

What Action Accomplishes

Motion A: Approves the First Amendment to extend the term and increase the not-to-exceed amounts of the agreement.

 

Motion B: Standardizes Korn Ferry suite of products, tools and intellectual property for all Broward County agencies.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/HUMAN RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

A foundational element of Broward County's Human Resources Strategy is the implementation and adoption of an integrated competency framework and supporting human resources tools. In 2020, the County engaged Korn Ferry and was provided access to Software as a Service (SaaS), called Korn Ferry Profile Manager. The Korn Ferry Profile Manager subscription provides access, export and use intellectual property (IP), including the KFLA competency library. As part of the Broward County Strategic Plan over the last five years, the County has embedded the KFLA competencies in the following processes and systems: County Four Core Values (Collaborates, Customer Focus, Instills Trust and Values Differences); job specific competencies (over 470 County job classification descriptions); job postings and interviews; performance management; and learning/training programs.

 

The Technology Products Agreement No. TEC2121745A1 provides Korn Ferry Leadership Architect (KFLA) competency framework and access to KFLA tools and intellectual property, including Digital Profile Manager. The competency framework is used to objectively build and detail organizational culture.

 

The First Amendment extends the agreement for up to five additional one-year terms, which will allow for continued use of the KFLA competency framework.

 

The Human Resources Division (HR) is requesting sole source standardization of Korn Ferry suite of products, tools and intellectual property, including KFLA (competency framework). The KFLA has been embedded in the County's Strategic Plan, Core Values, Job Classification Descriptions and HR processes. Standardization allows the County to maintain subscription and ensures continued use of Korn Ferry’s intellectual property used in the development of job-related competencies, job classification descriptions, recruitment, performance management, and learning and development processes; thus, making it more cost-effective than recreating these functions in another platform.

 

The First Amendment has been approved as to form and legal sufficiency by the County Attorney’s Office; there are no agreement disclosures.
