Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The applicant, Inverrary Association, Inc., requests approval of the First Amendment to the Declaration of Restrictive Covenants recorded in Book 4560, Page 870, of the Broward County Official Records, related to the revitalization of the Inverrary Golf Course Property.

 

The Golf Course Property is subject to certain recreational covenants originally adopted in 1971 that need to be amended to realize the revitalization plan for the Inverrary Community. At the April 14, 2026, County Commission meeting, the Board considered a Land Use Plan Amendment (PC 26-1) to change the land use from Commercial Recreation with a Dashed-Line Area to Irregular (9) Residential within a Dashed Line Area. The Original Declaration can be amended by the affirmative vote of not less than two-thirds (2/3) and Broward County has approximately 6.63 acres in real property interest in the land area described in Exhibit B of the Original Declaration (Exhibit 2).

 

The County Attorney’s Office has reviewed the request and approved to form the Joinder by Governmental Interest (Exhibit 4).
