Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE OFFICE OF MEDICAL EXAMINER AND TRAUMA SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project (Exhibit 2).

 

The contract provides for the removal, transportation and storage of deceased persons between various locations throughout Broward, Palm Beach and Miami-Dade Counties. Additional services include the transportation of medical records, specimens, and physical evidence for deceased persons.

 

The Director of Purchasing has determined the apparent low bidder, PackPlus, Inc. dba Josmar Medical Staffing, to be non-responsive to the pricing requirements for failure to submit prices for all line items and, based on the due diligence by OMETS, non-responsible for non-compliance with having a minimum of three vehicles, two stretchers per vehicle, and six employees.

 

The Director of Purchasing has determined the second apparent low bidder, Rightious Way Transportation LLC, to be non-responsive to the pricing requirements for failure to submit prices for all line items and, based on the due diligence by OMETS, non-responsible for non-compliance with having a minimum of six employees.

 

The Office of Medical Examiner and Trauma Services has reviewed the bid submitted by Removal Transport Services of Broward, Inc. and concurs with the recommendation for award (Exhibit 3).

 

One County vendor performance evaluation was completed for Removal Transport Services of Broward, Inc.; the vendor has an overall performance rating of 3.32 out of possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

 

The initial bid submitted by Removal Transport Services of Broward, Inc. was for the initial three-year amount of $1,920,198; the vendor offered a voluntary price reduction of $241,674, which reduced the initial three-year bid amount to $1,678,524. The Broward County Procurement Code, Section 21.41(b), allows for acceptance of a voluntary reduction in price after bid opening, if such reduction does not result in the modification or deletion of any condition of the solicitation. (Exhibit 4).

 

Incumbent: Removal Transport Services of Broward, Inc.; Contract No. GEN2118621P1, Removal and Transportation of Deceased Persons; Contract Term: January 28, 2020, through July 27, 2025. Expenditures to date: $1,316,949.

 

The bid was advertised on January 31, 2025, and opened on February 20, 2025; three bids were received with no declinations.

 

The Recommendation for Award was posted on the Purchasing Division website from April 18 - 25, 2025. There was no protest filed against this procurement.

 

The open-end contract consists of the County’s solicitation and the vendor’s response.

 

The initial contract period begins on the date of approval, and terminates three years from that date, unless extended.
