Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT AND SOLID WASTE AND RECYCLING SERVICES RECOMMENDS APPROVAL ON THE ABOVE MOTION.

 

In February 2001, the County entered into a lease agreement with Wheelabrator South Broward, Inc. ("Wheelabrator") to all for the operation of a waste-to-energy facility on County-owned land (the "Site Lease").  

 

In May 2015, Wheelabrator and the County amended, among other agreements, the Site Lease (the "Global Amendment"). The Global Amendment describes the methodology by which Wheelabrator and the County share in the responsibility to: fund the closure and long-term care costs of the ash monofil for the waste-to-energy plant (the “the South Broward Ash Monofill”); maintain the associated escrow account; and reimburse each other, as appropriate.

 

Section VI.L. of the Global Amendment, entitled “Funding of Closure and Long-Term Care Costs for the Ash Monofill,” requires the County to reimburse Wheelabrator for reasonable and eligible expenses it incurs in connection with the closure of portions of the South Broward Ash Monofill.

 

If approved, $2,178,900 would be transferred from the escrow account to reimburse Wheelabrator for reasonable and eligible expenses related to capping activities at the South Broward Ash Monofill.
